We, Boat Paradise complies with the regulations of the Hong Kong Marine Department.

The organiser of each booking has the responsibility to inform their guests of all charter information and the below Terms and Conditions to avoid miscommunications before, during and after the charter with Boat Paradise. Organisers are also responsible for their guests’ behaviour as well as any damage or loss caused by his/her guests.
Paying a deposit to secure a boat meaning you agree to all Boat Paradise Terms and Conditions.

General
All boats of Boat Paradise have Class IV certification and third-party insurance in accordance with Hong Kong’s regulations. Please note the third part insurance does not provide coverage for damage to personal property or individuals in many circumstances, for example personal accident or injury, drinking alcohol, eating food. However, if you want to further protect your guests and yourself, Boat Paradise suggests taking the One-Day Safe Local Travel Accident Insurance (contact us for details).
Boat Paradise reserves the rights to use photographs taken on your charter for marketing purposes. Please advise Boat Paradise if you do not wish to have any photos to be taken during your charter and used in any purposes.
Boat Paradise Boating owns the boat Infinity. It acts as an agent to facilitate the charter of other boats; however, it does not own or operate those other boats and shall not be liable for any loss or damage, howsoever arising, in respect of any charter of any boat other than Infinity. With respect to charters on Infinity, Boat Paradise Boating's liability for any loss or damage suffered by you or your guests shall not exceed the total charter fee of the relevant charter. Please note that all boat owners in Hong Kong are required by law to hold third party liability insurance.​
Passengers and Safety on Board

A list of guest names must be submitted to Boat Paradise at least 3 days before your charter. This is required by the Hong Kong Marine Department, the boat will not leave the pick-up location until the list is received by Boat Paradise.

The organiser must also submit the signed indemnity form to Boat Paradise at least 3 days before the charter and pass all information to the guests. The boat will not leave the pick-up location until the form is signed and received by Boat Paradise.

The captain has rights for decisions for the safety of the boat and may issue certain directions to the crew and guests should a situation appears.

The Captain reserves the right to control the music level on board. Following reckless or dangerous behaviour, the Captain reserves the right to return to the pier.

The captain has the rights to control the music level at any times. Music is not permitted during the time of the boat docking or anchoring, or at any times for safety purposes.

It is the responsible of parents to ensure the safety of their children. The suggested ration of adults to children is 1 to 2.

Pets are not allowed on any boats.

The number of guests arrive on the day should not exceed the maximum capacity of the boat. The captain will refuse to leave the pier if this happens.

Smoking is only allowed in the outdoor area of the boats.

Guests are solely responsible for their own personal safety and any property they bring on board.

Bringing and using of illegal substances on the boat is not permitted. If any illegal substances are found, captain will report to the Police immediately and the boat will return to the closest pier. Refund or compensation is not applicable in such case.

Dancing, running, jumping from the upper deck etc is not allowed. Guests will be responsible for any injuries, Boat Paradise takes no responsibility of this.

Swimming is not allowed once the sun goes down and for evening charters.

It is normal for guests to feel uncomfortable during rough waters. Seasick pills is recommended to be taken before the charter if needed.

Guests should be aware of any potential dangers on the boat, for example tripping hazards, moving parts, ropes and the boom on boats.

Guests should never throw any rubbish into the sea. Littering is an offence in Hong Kong.
External Equipment

If the organiser wishes to bring any significant audio equipment on the boat, he/she has to get an approval from Boat Paradise. Boat Paradise has all rights to reject any DJ equipment and speakers to be brought on the boat.

No DJ equipment is allowed to be connected to the boat’s sound system. Speakers have to be brought on board by the organisers themselves even if DJ equipment is pre-approved.

Most boats do not allow any external equipment. The captains has the rights to refuse external equipment that are brought onto the boat unapproved by Boat Paradise. Please check with Boat Paradise before booking.
Food and Drinks

Boat Paradise only acts as an agent to help organisers to organise food and drinks with external catering suppliers. For any disruptions of the charter, the charter organiser will still have to collect and pay for all food and drinks ordered.

In case more guests wish to board than what was originally confirmed and paid for, every extra guest will be charged for the food and drinks package price per person, regardless of whether the food and/or drinks are sufficient. This has to be paid in cash once guests are board or else the boat will not leave to its destination.

If less guests arrive on the day than what was confirmed and paid for, a refund for food and drinks is not applicable.

At the end of the charter, when the guests are leaving the boat at the drop off location, guests are not allowed to away any leftover food and drinks unless the food and drinks are brought onto the boat by the guests. If any items are taken off the boat by guests, Boat Paradise reserve the rights to send a bill to the organiser after the charter. We always put extra food and drinks on board to ensure guests do not run out during the charter so please do not take advantage of this.

Hiring the boat does not include hiring the kitchen and kitchen utensils. Plates, cups and cutlery are only provided when food and drinks are ordered with Boat Paradise, otherwise, guests will have to bring their own on board.
Service Providers
We may employ third-party companies and individuals due to the following reasons:

To facilitate our Service;

To provide the Service on our behalf;

To perform Service-related services; or
-
To assist us in analyzing how our Service is used.
We want to inform our Service users that these third parties have access to your Personal Information. The reason is to perform the tasks assigned to them on our behalf. However, they are obligated not to disclose or use the information for any other purpose.
Charter Information

Guests should depart and disembark at the same location. Different pick up & drop off point might be arranged with extra cost. This, however has to be discussed and confirmed with Boat Paradise before the charter.

Standard day charter time is 10.30am – 5.30pm and evening charter is 7pm – 11pm. Any time extension of the charter will incur overtime charge.

Overtime and Extra Fuel charges

Extra motoring hour will subject to extra fuel charge.

Extra charter hours might not be possible due to boat availabilities, please talk to the office in advance to confirm. (In the case that charters go overtime, which is out of the control of Hong Kong Yachting (i.e. guests not returning to boat in time for departure), additional charges will be incurred of HK$2000 per hour.)

If the organiser requests to return the drop off location before the charter ending time, refund or compensation will not be given.

Extra charter time or compensation will not be given in the case of late boarding at the fault of the guests.

If the charter goes overtime due to guests’ faults, extra charge will be charged to the organiser.

Payments for extra hours and extra fuel charges have to be settled before the charter with the office. Captain and crew do not handle payments.

Apart from the standard pick up/drop off locations, ad destinations, some boarding locations and destinations might incur extra charge, please confirm your destinations before your charter.

If the weather is not good, the captain has the rights to change the destination from what was agreed for the safety of the boat and guests. The captain however will definitely communicate with the organiser to provide the best options.

The boat will only stay in Hong Kong waters, unless international trip is arranged beforehand.
Damage caused by guests

All guests should make sure all furniture and equipment on board are in the same condition before and after the charter. The organiser will be responsible for the repair and replacement cost for any damage caused by his guests.

All equipment or facilities should be used under any applicable Hong Kong regulations or the instructions of the person who is responsible for the boat on the charter day. Guest who violates such rules will hold sole responsibility for the compensation of all damages or injury. Boat Paradise will not hold any responsible for any loss or damage but will report incidences to the police.
Mechanical Problem

Prior to the charter date, if there are mechanical issues and cannot be fixed, Boat Paradise will inform the organiser immediately. Boat Paradise will try to get a similar and reasonable boat as the original booked one. If no other boat is available, Boat Paradise will agree to change the charter date upon agreement within 6 months of the original charter date.

If mechanical problems happen during the charter, the captain shall try his best to fix the problem. The captain shall make arrangements to take all passengers back on land if the mechanical problems cannot be fixed. If compensation time is applicable, this will be discussed with Boat Paradise and the organiser on the first working day after the charter.

Our captains and crew only focus on the safety of all guests and the boat, please talk to the office for any negotiations.
For any cases mentioned above, if food and drinks have been ordered, guests will be responsible for the collection and payment for the goods. We, Boat Paradise complies with the regulations of the Hong Kong Marine Department.
